In brief

Several rules on the right of access apply by analogy to the right to data portability: the written request, cooperation in identification, responsibility where there are several controllers, the 30-day deadline and the exception to free-of-charge provision (Art. 16 paras. 1 and 5 and Arts. 17–19 DPO).

What does this mean for me?

You proceed in the same way as for an access request: ask in writing, cooperate in being identified and expect a reply within 30 days.

Example

You ask your streaming service in writing to hand over your usage data. The service must respond within 30 days and may only ask for a contribution to costs if the effort is disproportionate.

Implements these provisions of the Federal Act on Data Protection (FADP)

  1. Art. 28 FADPRight to data portability
  2. Art. 29 FADPRestrictions on the right to data portability
